The American border is complicated, particularly for anyone with a criminal record and/or a Canadian pardon. So let’s clarify a couple of things. Here are the starting points for anyone with a criminal record who is thinking of crossing the border.
- It is illegal for anyone with a criminal record to cross the border without a valid US entry waiver.
- A Canadian pardon is NOT recognized by American authorities.
However, as it turns out the border is not so simple because although Americans do not recognize a Canadian pardon the border officials DO NOT have access to a pardoned criminal record, unless:
- They have viewed the criminal record prior to receiving a pardon.
- You tell them about it.
The Pardon Association of Canada does NOT advise crossing the border without obtaining the proper documentation, if required. Although a Canadian pardon can suffice for border crossing, it is illegal and can land you in serious trouble if you are discovered to be crossing illegally.
